Short Title

Modifying criminal sentencing rules applicable in multiple conviction cases where consecutive sentences may be imposed by the sentencing judge and the sentence for the primary crime is a nonprison sentence.

Senator Warren opened the hearing on SB412.

Jenna Moyer, Revisor's office, provided an overview of the bill and stood for questions. (Attachment 3)

Melissa Schoen, Kansas County and District Attorneys provided testimony in support of SB412.  Her testimony states that this bill imposes one probation length for all sentences within a case, keeping the entire underlying prison sentence revocable if the defendant violates probation. (Attachment 4)

Jennifer Roth, Kansas State Board of Indigents defense services, provided testimony in opposition to SB412. Her testimony stated the proposed changes to the bill are contrary to Kansas's sentencing scheme and guidelines. (Attachment 5)

The conferees stood for questions.

No further testimony.

Chairwoman Warren closed the hearing on SB412. 

Meeting minutes for 1-30 and 1-31 were submitted for review and any suggestions. The Chairwoman asked if there was a motion to approved the minutes as submitted.  Senator Olson moved and Senator Haley seconded the motion. The motion carried.
